Terms of Service

1. Acceptance of Terms
By accessing or using Paynest ("the Service"), a product by Zurk, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our service.
These terms apply to all users including business owners, employees, and job seekers using the Paynest platform.
2. Description of Service
Paynest provides the following services:
- Employee attendance management with photo and GPS verification
- Salary calculation and management tools
- Job posting and hiring platform for small businesses
- Employee profile and leave management
- Business dashboard and reporting tools
3. User Accounts
To use Paynest, you must:
- Provide accurate and complete registration information
- Maintain the security of your account credentials
- Notify us immediately of any unauthorized account access
- Be at least 18 years of age
- Be legally authorized to operate a business (for Owner accounts)
⚠️ You are responsible for all activities that occur under your account.
4. Owner Responsibilities
As a business owner using Paynest, you agree to:
- Provide accurate business and employee information
- Use attendance data only for legitimate employment purposes
- Inform employees about attendance tracking and photo capture
- Maintain confidentiality of employee data
- Pay subscription fees on time to maintain service access
- Not share your account credentials with unauthorized persons
5. Employee Responsibilities
As an employee using Paynest, you agree to:
- Use only your assigned Employee ID to login
- Mark attendance honestly and accurately
- Not attempt to fake attendance or location
- Keep your login credentials confidential
- Not access other employees' data
6. Subscription & Payment
Paynest operates on a subscription model:
- Starter Plan: ₹99/month for up to 10 employees
- Business Plan: ₹199/month for up to 50 employees
- Subscriptions are billed monthly
- Service access is suspended upon subscription expiry
- No refunds for partial months of service
All payments are processed securely. Subscription renewal is required to maintain uninterrupted service.
7. Prohibited Activities
You may not use Paynest to:
- Submit false or misleading attendance records
- Harass, abuse, or harm other users
- Attempt to bypass security measures
- Use the platform for illegal employment practices
- Post fraudulent job listings
- Collect or harvest other users' data without consent
- Reverse engineer or attempt to extract source code
8. Job Board Terms
For job postings and applications:
- Job postings must be genuine and accurate
- Employers must not discriminate unlawfully
- Job seekers must provide truthful information
- Paynest acts as a platform only — not as an employer or recruiter
- We are not responsible for employment outcomes
9. Intellectual Property
All content, features, and functionality of Paynest including but not limited to text, graphics, logos, and software are the exclusive property of Zurk and are protected by applicable intellectual property laws.
10. Limitation of Liability
Paynest and Zurk shall not be liable for:
- Any indirect or consequential damages
- Loss of data or business interruption
- Accuracy of GPS location data
- Employment disputes between owners and employees
- Third-party actions or content
11. Termination
We reserve the right to suspend or terminate your account if you violate these Terms of Service. You may also terminate your account at any time by contacting us.
12. Governing Law
These Terms shall be governed by and construed in accordance with the laws of India. Any disputes shall be subject to the exclusive jurisdiction of courts in India.
13. Changes to Terms
We reserve the right to modify these terms at any time. Continued use of the service after changes constitutes acceptance of the new terms.
